Terms of Service

These terms govern your use of Holloway (“the Service”) — an AI receptionist that answers phone calls in your business’s name, takes messages, captures leads into your connected CRM, and notifies you. By creating an account or subscribing you agree to these terms.

1. What the Service does

Holloway provisions a phone number for your business (or receives calls you forward to it) and uses artificial intelligence to answer callers, answer questions from the business information you provide, take messages, book appointments where you’ve connected a calendar, and record what happened so you can review it. Calls and text messages are transcribed and stored in your dashboard.

2. AI limitations — read this one

The Service is powered by AI. It is designed to say “I’ll take a message” rather than guess, but like any AI it can mishear, misunderstand, or make mistakes. You are responsible for reviewing captured leads and messages. The Service is not an emergency service and must not be relied on for emergency response; callers with emergencies are directed to appropriate emergency services.

3. Your responsibilities

You are responsible for: (a) the accuracy of the business information, prices, and policies you give Holloway to quote from; (b) using the Service lawfully, including any notice or consent your jurisdiction requires you to give your callers about call recording, transcription, or AI participation on the call; (c) keeping your account credentials and connected integrations (CRM, calendar, email) secure; and (d) anything you approve the assistant to send on your behalf.

4. Billing

The Service is a monthly subscription billed through Stripe. You can cancel any time from Settings; service continues to the end of the paid period. If your subscription lapses, inbound answering stops and your provisioned number may be reclaimed after a grace period. Fees are non-refundable except where required by law.

5. Your data

Your business data, call transcripts, and captured leads are yours. How we handle data is described in the Privacy Policy. You can request deletion of your account and its data at any time.

6. Disclaimers and liability

The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Holloway’s total liability for any claim arising from the Service is limited to the fees you paid in the three months before the claim. Holloway is not liable for indirect or consequential damages, including lost business from a missed or mishandled call.

7. Changes and termination

We may update these terms; material changes will be notified in the dashboard or by email, and continued use after notice is acceptance. We may suspend or terminate accounts that abuse the Service or use it unlawfully.
